RIGHTS AND OBLIGATIONS OF THE HOLDER OF THE EUROPEAN YOUTH CARD EURO <26 HEREINAFTER REFERRED TO AS A CARD
§ 1
All discounts and considerations related to the ownership of the card are reserved to an authorised holder of the card in all its editions.
§ 2
1. An authorized holder of the card issued independently or in cooperation with another subject by the Polish Youth Card Association (hereinafter referred to as Association) – a member of the European Youth Card Association (EYCA) with the seat in Budapest – is a natural person who meets the requirements below:
1. On the date of purchase is at least 7 years old and has not exceed the age of 30;
2. Whose entitlements have not expired (see § 8).
2. An authorized holder of the EURO<26 STUDENT card is a person who has not exceed the age of 30 on the date of purchase and is a pupil or student (taking into consideration all types of schools and modes of educations).
3. An authorized holder of the card issued by the card editor in his country (see the list in the Polish Discount Guide) – a member of the European Youth Card Association – is a person who has purchased the card on conditions set by the editors.
§ 3
A person, who becomes a cardholder without having met the requirements provided for in § 2, shall not acquire any entitlements resulting from the card and is not entitled to demand the refund of the amount paid for a guide and a card.
§ 4
An authorized cardholder is entitled – on the basis of agreements concluded by the Association and European Integration Foundation in Gdańsk – to demand discounts and other considerations referred to in the Discount Guide from the institutions mentioned therein. In the case when a subject mentioned in the guide refuses to give a discount, the cardholder is entitled to lay a claim against him and inform the Association about this fact.
Some discount givers reserve themselves a right to lower the amount of discount or to refuse a discount in the case of paying by bank card.
§ 5
The representative of the institution that accepts the card may ask the holder to present an ID card to prove the identity of a person using the card. The holder should agree to this request.
§ 6
Taking advantage of discounts and considerations gained by the card editors in other countries shall take place in accordance with the rules set by them and included in the discount guides appropriate to individual countries. The cardholder can obtain information about discounts and considerations available in other countries in places described in the Polish Card Discount Guide.
§ 7
In the case the card gets damaged or worn out, the card holder is entitled to have this card replaced with a new one. In the case of damage or loss a duplicate card can be issued directly from the Association for the price set in the price list. The expiry date on a duplicate is the same with that on the card damaged or lost. The holder, to whom a duplicate is issued, is not entitled to any additional insurance rights or other considerations as a duplicate is only a proof that the rights he acquired before continue.
§ 8
1. The expiry date of the card is 12 months form the date of purchase.
2. Should the card be issued in cooperation with banks, the expiry period of 12 months starts with the date of its issue.
§ 9
Should an authorised cardholder hand his card over to a third person, his entitlements related to the card expire automatically. If the Association learns that the card has been handed over, it will make it impossible for the holder to take advantage of the discounts and considerations related to the card after verifying this information. The person, whose rights expired due to the grounds mentioned above, is not entitled to reimbursement of the amount of money paid for the guide and the card.
§ 10
Regulations on EURO<26 card made in cooperation with banks, and particularly the conditions to be met in order to obtain a card, rules for using a card, its expiry date, possibility to get a duplicate are all provided for in the account rules, i.e. a special agreement combining cards and other banking rules. Should there be any contradictions between these rules and the banking rules, the latter shall prevail.
§ 11
The rules related to purchase and use, as well as the card offer which is edited by the Association together with another subject, may be regulated separately in the rules and other documents suitable for the card and agreed upon by the Association and a cooperating subject. The provisions of these Rules shall not apply or shall apply accordingly to the scope regulated by the documents mentioned above.
